Privacy statement and rules for the use of cookies on the MIVARDI.COM website

The purpose of this Privacy Statement is to inform you about the manner and extent of processing of your personal data on the Mivardi.com website. Personal data is information that is directly or indirectly associated with your person or that can be associated with your person. The legislation governing the protection of personal data is primarily the General Data Protection Regulation (GDPR) and Act No. 127/2005 Coll. on Electronic Communications.

1. General information

The processing of personal data on the Mivardi.com website is carried out by its provider, MIVARDI, s.r.o. When you visit our website, various information is exchanged between your terminal device and our server. This may also include personal data. The information thus obtained is used, among other things, for the purpose of optimizing our website or for the purpose of displaying advertisements in your terminal device's browser.

2. Visiting our website

Purposes of the processing of personal data / legal basis:

When you visit our website using your terminal device, the following data is sent and stored via your browser and without your involvement:

the IP address of the internet-connected device that sent the request;

the date and time of access;

the name and URL of the displayed file;

an indication of the website/application from which the access was made (referrer URL);

an indication of the browser used, or the operating system of the Internet-connected terminal device used;

an indication of the Internet Service Provider.

These data are temporarily stored on our website server as so-called log files for the following purposes:

      to ensure a smooth connection to our website;

      to ensure comfortable use of our website/applications;

      evaluating system security and stability.

The legal basis for the processing of the IP address is Article 6(1)(f) GDPR. Our legitimate interest lies in the aforementioned purposes of processing personal data.

Retention period:

Personal data is stored for one month and then automatically deleted.

3. Use of cookies

Pursuant to Section 89 of Act No. 127/2005 Coll., on electronic communications, we would like to inform you that our website www.mivardi.com uses so-called cookies, i.e. small text files that our website saves on your terminal device. Thanks to cookies, the website records information about your visit, such as information about your preferred language and other settings. This can make your next visit to this website much easier.

Cookies are not used to collect any sensitive personal information or to identify you as a specific person.

The use of such data is only permissible if you, as the user, agree to it in advance.

You can give this consent by clicking on the Accept All button in the top right corner of the cookie bar displayed on www.mivardi.com. The expression of consent is not necessary for the processing of tracking data, which is necessary for the technical functioning and correct display of this website.

If your personal data relating to your behaviour on www.mivardi.com may be used for analytical and marketing purposes and this data may also be shared by other providers, for example for the purpose of "enriching their own information", then such use will only take place if you have given your prior consent. In this case, the further processing of the data regularly collected on mivardi.com is the sole responsibility of the providers.

As part of this further processing, the service providers may transfer data to the USA. As far as the USA is concerned, the European Court of Justice has stated that it is a country with inadequate protection of personal data. In this context, there is a particular risk that your personal data will be processed by US institutions/authorities for control or monitoring purposes without you having the possibility to use the relevant legal means.

The tracking data that MIVARDI s.r.o. independently collects and stores will be processed exclusively as pseudonymised data. This use prevents the data from being attributed to your person. If you wish to delete individual cookies in your browser or if you wish to find out which service providers have stored cookies in your browser, you can do so by clicking on the Detailed cookie settings button.

The user also has the option to set their browser to prevent cookies from being stored or to allow only certain types of cookies to be stored. Details regarding the possibility to change the settings of common browser types (including Google Chrome, Firefox) are provided in section 4.2 of this declaration.

3.1 Cookies - General information and consent requirements

This website uses cookies. Cookies are small text files that are automatically created by the browser and stored on the user's end device (laptop, tablet, smartphone, etc.). Cookies store information that is always generated in connection with the specific end device used by the user. However, this does not mean that we gain direct knowledge of your identity.

Some of the cookies we use on this website are deleted immediately after closing the browser (so-called temporary cookies, session cookies). These cookies allow us, for example, to track the number of page views. Other cookies remain on your computer longer and allow us to identify your computer during your next visit (so-called long-term cookies). These cookies are used, for example, to track visits across our websites or to track the performance of our marketing campaigns.

In accordance with legal requirements, the storage of information on terminal devices (desktops, mobile phones, tablets, etc.) - e.g. by setting cookies - and the retrieval of information from terminal devices is only permitted on the basis of your active consent. Your consent is not required if this data storage/retrieval is necessary for the functioning of the website. This necessity applies, for example, to the provision of the following functions:

      Displaying the website,

      Ensuring system security.

You have no right to object to the processing of data that is necessary for the operation of the website.

As a user, you may use the www.mivardi.com website without collecting or storing data on your end device for purposes that are not necessary for the use of this website. Unless you give further consent to this processing, only "basic tracking" - i.e. the use of only necessary cookies - will be activated when using this website.

3.3 Consent management

We use a proprietary solution to manage the settings and document the consent of users of our services, which is used to store cookie settings for the entire site. We use it to store information not only about the categories of cookies used on our site, but also whether users have consented or withdrawn their consent to use a particular category. This solution allows us to allow the use of cookies that fall into only those categories for which users have given us active consent. Files from other categories will not be allowed on the site if consent is not given.

3.4 Consent to the use of individual online services/tracking data collection

As mentioned in section 3.1, we collect and process data obtained in connection with the use of cookies partly on the basis of your consent.

You can give this consent by clicking on the Accept All button in the top right corner of the cookie bar displayed on www.mivardi.com. By doing so, you consent to MIVARDI s.r.o. storing data on your terminal device (e.g. by setting cookies) or to the collection of data from your terminal device. In addition, by clicking the Accept All button, you consent to the use of certain third-party advertising features.

By clicking on Detailed Cookie Settings at the bottom of the cookie bar, you have the option to go to Cookie Settings and manage your consent preferences. You can subsequently change your consent and preferences in these settings at any time. Clicking on the Refuse All button will disable the use of cookies on the site except for essential cookies.

The settings distinguish between "technical cookies", "analytical cookies" and "marketing cookies". The data processing that takes place in connection with these marketing functions is described below (sections 3.4.1 to 3.4.3 of this declaration).

All data processing that takes place on the basis of your consent expressed by clicking on the "Accept All" button serves the same purpose, namely advertising.

All consents given by clicking the Accept All button on the cookie bar can be revoked by viewing the Detailed Cookie Settings again (link below) and clicking the Refuse All button.

3.4.1. Technically necessary cookies / functional (no consent required)

These are technical (functional) cookies that are necessary for the proper functioning of our website and all the functions it offers. They are responsible for, among other things, storing products in the shopping cart, displaying products on the wish list, managing filters and the shopping process, integrating security functionalities including billing or storing privacy settings.

Your consent is not required for the use of strictly necessary cookies on our website. For this reason, functional cookies cannot be individually disabled or enabled.

3.4.1.1. Google reCaptcha

To further protect your data, we also use the reCAPTCHA function of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google") on this website. This function is primarily used to distinguish whether a human is attempting to log in or whether machine and automated processing is taking place and thus protects against so-called brute force attacks, for example.

The service involves the transmission of the IP address and, where applicable, other data required by Google for Google's reCAPTCHA service and is carried out in accordance with Article 6(1)(f) GDPR on the basis of our legitimate interest in establishing individual responsibility on the Internet and preventing abuse and spam. The use of Google reCAPTCHA may also involve the transfer of personal data to Google LLC. servers in the USA.

3.4.2 Consent to cookies for analysis

Analytics cookies allow us to measure the performance of our website and our advertising campaigns. We use them to determine the number of visits and the origin of the visits that come to our site. The data we collect is processed in bulk form, so it is not possible to draw conclusions about a specific website user. If you disable support for analytics cookies, we will not be able to analyse the performance of our website and optimise it in terms of your visits.

3.4.2.1 Consent to the use of Google Analytics

In order to continuously optimize the www.mivardi.com website according to your needs and to support our marketing activities, data is processed by Google Analytics on the basis of your consent.

Google Analytics is an analytics network service of Google Inc. (Google). Google Analytics uses text cookies that are stored on your computer and enable an analysis of your use of the website. Google uses this information to evaluate the use of the Mivardi.com website by users and to compile reports on website activity. Google processes the data collected using the basic version of Google Analytics exclusively on behalf of MIVARDI s.r.o. and for the purposes of the mivardi.com website.

The legal basis for this processing is Article 6(1)(a) GDPR (consent).

You can withdraw your consent to the use of Google Analytics at any time in our Detailed Cookie Settings by unchecking the category Analytical cookies.

3.4.3. Consent to cookies for personalisation and marketing purposes

In order to better tailor our store to the needs and interests of our customers and to provide an exceptional shopping experience, we also use other tracking data. By using personalised cookies, we can avoid displaying unwanted information, such as incorrect product recommendations or offers that cannot be used. In addition, the use of personalised cookies enables us to offer you additional functionalities such as product recommendations tailored to your expectations.

Advertising cookies are used by us or our partners to display relevant content or advertisements to users on our website or on the websites of others. This allows us to create so-called pseudonymised profiles based on your interests. It is usually not possible to directly identify you through this information, as only pseudonymised information is used. If the user does not consent to the use of these cookies, they will receive less relevant content and advertisements that are not tailored to their interests and hobbies.

3.4.3.1. Consent for Google AdSense

Our website uses Google AdSense. Google AdSense is an internet advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google). This program makes it easier for us to track the conversion performance and success of our marketing campaigns. Your surfing behaviour on our website is analysed for this purpose.

For this purpose, Google places a cookie on your browser when you use Google services or visit websites in the Google advertising network. This cookie is used to track your visits to the site. The cookie is used to uniquely identify the browser, not to identify the user. Such further processing of data, similar to the processing of data transmitted to Google by us, is carried out by Google as the sole data controller. If Google Ireland Limited processes your data as the sole data controller, it is possible that your data will be transferred to Google Ireland Limited in the USA. The European Court of Justice has found, with reference to the USA, that it is a country with an inadequate level of data protection. In this context, there is a particular risk that your personal data will be processed by US institutions/authorities for control and monitoring purposes without you being able to avail of the relevant legal remedies.

The legal basis for this data processing is Article 6(1)(a) GDPR (consent).

More information on Google marketing and Google's privacy policy can be found here. Here you can also assert your subjective rights (e.g. the right to erasure) in relation to the data processed by Google as data controller.

The user can withdraw his/her consent to the use of Google services at any time by unchecking the Marketing cookies category in the detailed cookie settings.

3.4.3.2. Consent to retargeting on Facebook (Website-Custom-Audience)

The pixel of Facebook Ireland Limited is integrated with this website (pixel of non-standard users of the page). Through this pixel, information about the use of this website is collected by Facebook Ireland Limited. This information can be associated with your person by means of other information that Facebook Ireland Limited holds about you, for example in connection with your Facebook account. Based on the information collected by pixel, ads related to your interest in our offers (retargeting) may be displayed on your Facebook account.

The information collected by this pixel may also be aggregated by Facebook Ireland Limited and the aggregated information may be used by Facebook Ireland Limited for its own internet purposes as well as for third party purposes. For example, Facebook Ireland Limited may infer some of the user's interests based on the user's browsing behaviour on this website and may use this information to promote the offerings of other parties. Facebook Ireland Limited may also combine the information collected by the pixel with other information that Facebook Ireland Limited has collected about the user through other parties and/or in connection with the use of Facebook so that the user's profile may be stored by Facebook Ireland Limited. This profile may then be used for advertising purposes.

Facebook Ireland Limited is solely responsible for the permanent storage and further processing of the tracking data collected via the non-standard public pixel also used on this website. To the extent that Facebook Ireland Limited processes the data as the sole controller of this data, there is the possibility that this data will be transferred by Facebook Ireland Limited to the USA. The European Court of Justice has found the USA to be a country with an inadequate level of data protection. In this context, there is a particular risk that your personal data will be processed by US institutions/authorities for control and monitoring purposes without you being able to avail of the relevant legal remedies. The legal basis for this data processing is Article 6(1)(a) GDPR (consent).

More information on data protection at Facebook Ireland Limited can be found here. You can also exercise your rights (e.g. data deletion rights) against Facebook Ireland Limited here.

The user can revoke their consent to the transfer of data to Facebook Ireland Limited via a pixel on this website by unticking the Marketing Cookies category in the Detailed Cookie Settings.
